手搖飲料的名稱也有商標議題（三）－商標自己很久沒用沒關係，有授權他人使用也行！
取得商標權之後，權利並不是永久存在，如果你自始就沒有使用它或者已經很久沒有使用它，那麼，任何人都可以去申請「廢止」它。畢竟，商標存在的目的，是要促使消費者能夠知道怎麼對商品或服務做出選擇，進而促進商業環境的發展。
長沂國際實業創立的知名茶飲COMEBUY，發現暢銷飲品「海神」的名稱，被有心人士搶先註冊商標之後，開始想方設法要讓對方的商標權失其效力。
長沂國際實業打出的第一招，「評定」程序，並沒有成功，主要原因所提出的證據顯示「海神」並沒有成為著名商標。

長沂國際實業打出的第二招，是於2021年8月18日提出「廢止」程序！
長沂國際實業的主張是，經過查詢商標登記地址、商標權人經營的餐廳菜單等，都沒有發現商標權人有使用「海神」作為商標使用。
商標權人則反駁，這個商標其實有授權給「鯨海餐飲事業有限公司」使用在「茶葉、粉圓」的商品上，有採購原料的發票及收據、商品包裝、廣告之設計圖與實照、銷售商品統一發票、部落格美食文章等證據。
智慧財產局在審查這件廢止案，有幾個重要的面向：
其一，商標是不是有以行銷之目的作使用，不管是商標權人自己使用，還是由被授權人使用皆可
其二，商標是否有使用，是自廢止案之申請日往前算三年來看
智慧局審查之後認為，商標權人確實在2019年1月28日起將商標授權給鯨海餐飲，而且鯨海餐飲於2021年5-6月之間所開立的統一發票及營業銷售額與稅額申請書，確實有「餐飲-海神冷泡茶」與「海神粉圓」的字樣，且證據也顯示他們有進貨茶葉、粉圓等原料，所以可以認定他們有銷售標有「海神」的茶葉及粉圓商品。
智慧局因而在這兩個品項「茶葉、粉圓」，作出廢止不成立的決定（請參閱中台廢字第L01100458號），即「海神」文字在「茶葉」品項的商標權仍然屬於別人的，這也是為什麼COMEBUY不得不更名的原因。
這案例也提醒所有商標權人，若自己的商標權並沒有使用，可以考慮授權給他人作使用，又，平時進行商業交易或從事其他商業活動時，要把使用註冊商標的證據給留存下來，以供未來舉證使用。
