專利師公會嚴正聲明：商標代理人新制應保障現有代理人工作權，專利師公會不贊同全國律師聯合會112年4月19日對於商標代理人新制之聲明
現行商標法對於商標代理人並無任何資格限制，現有專門職業及技術人員國家考試亦無商標師之考試類別，故行政院於112年3月9日所通過之商標法修正草案中，即針對商標代理人之資格新增規範。依行政院之草案，除依法得執行商標代理業務之專門執業人員外，任何在國內設有住所者，僅需經過商標專責機關舉辦之商標專業能力認證考試及格，即得執行商標代理業務，期能提高商標代理之品質，確保商標申請人之權益。而為兼顧新法施行前已從事商標代理業務者之工作權，草案中另規定：於新法施行前三年持續從商標代理業務，且每年辦理申請商標註冊及其他程序案件達十件者，得於新法施行翌日起一年內申請登錄為商標代理人，無須經過前述認證考試，俾因應現實及提昇商標代理業務之專業性。本會對於主管機關修法之意旨，甚表贊同。
然全國律師聯合會（下稱全律會）於112年4月19日發布聲明並提出修正建議，主張刪除前述保障現有商標代理人之規定，本公會對此表達堅決反對之立場，簡述理由如後：
一、全律會之主張將嚴重衝擊包括本會會員在內的廣大商標代理人及相關從業人員之工作權，亦影響商標申請人之權益
依據統計，我國每年商標申請案近十萬件，其中由本會會員所代理的商標案件即佔全體商標案件的三成以上，此外亦有數百位非律師亦非會計師之商標代理人代理眾多案件，從事商標相關工作者粗估亦有數千人。一旦全律會之建議草案獲得通過並施行，勢對彼等工作權造成重大衝擊，更影響其所代理數萬件商標申請案之申請人的權益，不可不慎。
二、專利師透過公會自治，積極提升商標專業能力，深具商標業務實務經驗及本職學能
本會之專利師經過國家專技高考及格，對於行政法及相關訴訟法規，本有充分掌握。再者，本會於2008年成立之初，即在章程中規定應設置商標實務委員會；專利師從通過國家考試參與職前訓練開始，及至正式執業時，本會每年皆規劃並舉辦多場商標法令及實務等相關課程，甚且與外國專家舉辦多次跨國商標研討會，孕育培養出大量優秀的商標專業人才。
事實上，專利事務所同時代理商標案件早已是極為普遍之現狀，其中由本會會員代理之商標案件佔全體商標案件之三成以上，已如前述，顯見專利師在處理商標案件方面確實具有相當專業及深厚經驗，始能受當事人信賴委任代理數萬件商標申請案件，故商標法草案實無針對已具備相當商標代理經驗之專利師（及其他商標代理人），再要求比照無經驗者亦需經認證考試之必要。
況且，本會目前亦積極與智慧財產局協商專利師法之配套修正，擬規定欲從事商標業務之專利師應接受專利師公會所舉辦一定時數之商標訓練課程，其本職學能必將遠高於只經過認證考試之商標代理人，從而提高商標業務之專業度，且符合國內外潮流及產業發展。
綜上，本會認為行政院之商標法草案已能兼顧商標代理品質之提昇及各方執業人士工作權之保障，且能符合商標代理業界實況以及商標申請人與商標權人之需求。本會在此呼籲立法院及社會各界予以支持
