手搖飲料的名稱也有商標議題（二）－COMEBUY無法證明「海神」已是著名商標，成為評定不成立的關鍵
由長沂國際實業創立的知名茶飲COMEBUY，宣布將暢銷飲品「海神」改名為「嗨神」，原因居然是被其他有心人士搶先註冊商標！上一篇分享有提到，其實長沂國際實業當然有一些動作，即有針對註冊第01830579號「海神」商標（以下簡稱海神商標）提出法律上的救濟程序，想要讓海神商標被撤銷或被廢止（更白話來理解，就是想要讓它失其效力）。

首先，海神商標是2016年7月提出申請，2017年3月核准註冊，但長沂國際實業遲至2021年3月與2021年8月才分別提出「評定程序」與「廢止程序」（未見有異議案）。這裡就可以先分享一點，如果企業有提前認知「商標監控」的概念，或許會更早警覺事業的潛在風險。
我們就先來看看評定案。
長沂國際實業主張「COMEBUY」已被認定為著名商標，而「海神」是他們的代表性飲品，銷售量節節攀升，也成為著名商標，又，長沂國際實業也”曾經”在台中有過不少門市，故主張海神商標有不得註冊之事由，具體而言，為其有致公眾混淆誤認之虞或有減損著名商標之識別性或信譽之虞，以及有意圖仿襲之情形（即商標法第30條第1項第11、12款之規定，有興趣的再自行查詢法條內容），應該要被撤銷！
海神商標的商標權人則答辯：
- 長沂國際實業只是將「海神」作為飲料名稱，並非是將其作為商標使用
- 長沂國際實業提供的使用證據，無法證明「海神」已臻著名
- 「海神」屬任意性標識，自然有可能被任何人作為商標申請註冊
- 「COMEBUY」當時在台中之店數為零，顯見長沂國際實業根本未在意台中市場之經營，認為其有抄襲或攀附之意圖，實屬荒謬
（備註： 文章撰寫當下，COMEBUY於台中有兩間店，為2024年6月開幕的台中太平店及2024年7月開幕的台中昌平店）
對此，智慧局認同海神商標之商標權人的主張，即長沂國際實業的「海神」並非著名商標，原因是根據所提出的證據資料，相關心得討論文數量不豐，官方臉書等網頁未見熱度，內部銷售數據無法勾稽且不等同「海神」之使用，同時也沒有相關商品之銷售排名、市場占有率等資料可供參酌。
再者，智慧局強調「商標權人是否基於仿襲意圖所為，應斟酌契約、地緣、業務往來或其他關係等客觀存在之事實及證據，依據論理法則及經驗法則加以判斷」，而長沂國際實業並未就「COMEBUY當時在台中之店數為零」提出進一步說明，故，實在難以認定長沂國際實業與海神商標的商標權人具有地緣關係。
綜上之理由，智慧局因而作出評定不成立之決定（中台評字第H01100025號）！
