手搖飲料的名稱也有商標議題（一）－ COMEBUY宣布「海神」商標遭他人搶註，改名為「嗨神」
台灣人愛喝手搖飲料，一年喝掉超過十萬杯！手搖飲料的品項琳瑯滿目，許多業者甚至會替它們取一些特殊的名稱，來吸引消費者並與其他業者做出區別。（嗯~~也有可能是使消費者更加混淆？筆者每次去可不可熟成紅茶，總要站在菜單前查看許久…，胭脂冷露/胭脂歐蕾/冷露歐蕾？）
你可能沒有想過，原來這些飲料名稱也有商標的議題！
報載，由長沂國際實業創立的知名茶飲COMEBUY，宣布將暢銷飲品「海神」改名為「嗨神」，原因居然是被其他有心人士搶先註冊商標！長沂國際實業還表示，以前各品牌蓬勃發展，彼此皆是良性競爭與互動，誰也不會去註冊競業的商品名字，也因此疏忽最重要的冠軍飲品商標！（這案例真的太有趣，筆者也常點海神奶茶）
雖然新聞內容沒有具體指出所謂的有心人士，但經筆者查詢，很快就可以發現一件長沂國際實業透過「評定程序」（認為其有致公眾混淆誤認之虞，又，有意圖仿襲之情形，故應不得註冊）與「廢止程序」（認為其於取得註冊後有三年未使用，而應廢止之情形），仍然無法將其弄掉的商標案，即註冊第01830579號「海神」商標（這件商標的申請人，似乎是北澤國際餐飲集團的董事長）！
有了這次經驗（教訓？），長沂國際實業當然學乖了！於宣布改名為「嗨神」之前，在2025年2月17日已經就「嗨神」的文字提出商標申請，並於同年4月16日取得註冊！這次不會為人作嫁了！
